GENERAL TERMS AND CONDITIONS

The owner of the online store www.yelvio.com (hereinafter the Online Store) is TWO CHAPTERS STUDIOS OÜ (registry code 16311506), located at Katusepapi tn 16b, 11412 Tallinn, Harju maakond, Estonia, VAT number EE102409897 (hereinafter the Seller or Yelvio).

By using the Online Store, you agree to these Terms and Conditions.

1. SCOPE AND VALIDITY OF THE TERMS

1.1. These General Terms and Conditions (hereinafter the Terms) apply to all purchase–sale contracts (hereinafter the Contract) concluded between a natural person or legal entity (hereinafter the Customer) and the Seller through the Online Store.

1.2. The Terms apply to the purchase of goods and, where applicable, services offered in the Online Store (hereinafter collectively the Products).

1.3. In addition to these Terms, the relationship between the Customer and the Seller is governed by:

  • Applicable legislation of the Republic of Estonia and the European Union
  • The Seller’s Privacy Policy
  • The Seller’s Cookie Policy
  • The Seller’s Shipping Policy, and
  • The Seller’s Return & Refund Policy and Warranty & Complaints Procedure.

1.4. If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.

2. PRODUCTS, PRICES AND AVAILABILITY

2.1. Product information, including descriptions, key features and prices, is provided next to the Product in the Online Store.

2.2. All prices in the Online Store are shown in Euros (€) and, unless stated otherwise, include applicable VAT in accordance with current legislation.

Shipping, handling and any additional fees (e.g. customs or import charges for certain destinations) are displayed separately at checkout.

2.3. The Seller reserves the right to change prices at any time. The price applicable to the Customer is the price shown at the time the order is placed and confirmed.

2.4. Product photos are illustrative and may differ slightly from the actual Product due to screen settings, lighting and other factors.

The Seller makes reasonable efforts to ensure that descriptions, measurements, colours and materials are accurate.

2.5. Product availability is not guaranteed. If a Product is out of stock or cannot be delivered after the Customer has placed an order, the Seller will inform the Customer as soon as possible and refund the amount paid (including standard shipping fees) within 14 days.

3. PLACING AN ORDER

3.1. The Customer can place orders in the Online Store either as a guest or as a registered user.

3.2. To order Products, the Customer must:

  • Add the desired Products to the shopping cart
  • Proceed to checkout
  • Fill in the required fields (name, email, shipping address, phone number, etc.)
  • Select the preferred shipping method
  • Select the payment method
  • Confirm that they have read and agree to these Terms and the Privacy Policy
  • Confirm and submit the order.

3.3. Before confirming the order, the Customer will see an overview of the order, including Products, quantities, prices, shipping fees and total amount. The Customer is responsible for checking and ensuring the correctness of the information.

3.4. The Contract between the Customer and the Seller is deemed to be concluded when the Customer has:

  • Submitted the order through the Online Store, and
  • Successfully completed payment via one of the available payment methods.

3.5. After successful payment, the Customer will receive an order confirmation email.

3.6. The Seller may refuse or cancel an order, for example, if:

  • The Product is not available
  • The Customer’s data is incomplete or incorrect
  • Payment is not completed or is reversed
  • There is reasonable suspicion of fraud or misuse.

If the order is cancelled after payment, the Seller will refund the amount paid within 14 days.

4. PAYMENT METHODS

4.1. Payments in the Online Store are processed securely via the payment service provider Maksekeskus AS (MakeCommerce).

4.2. The Customer can pay using the payment methods supported by Maksekeskus AS and activated in the Online Store, which may include:

  • Estonian bank links (via Maksekeskus AS): Swedbank, SEB, Luminor, LHV, Coop Pank, and other supported banks.
  • Card payments: Visa, MasterCard (and other card brands as supported by Maksekeskus AS).
  • Buy now, pay later / instalment solutions: Inbank, ESTO (and other supported providers, if activated in the store).

4.3. The available payment options may vary depending on the Customer’s country and the configuration of the Online Store.

4.4. When paying via bank link, after confirming the payment, the Customer must click the “Return to merchant” button in order to finalize the order properly.

4.5. The personal data necessary for the execution of payments is transferred to the authorized processor Maksekeskus AS.

4.6. All payments must be made in Euros (€). Any fees charged by the Customer’s bank or card issuer (e.g. currency conversion fees) are the Customer’s responsibility.

5. SHIPPING, DELIVERY AND RISK TRANSFER

5.1. The Online Store ships Products to countries within the European Union.

5.2. The following delivery methods may be available, depending on the Customer’s location and the Products ordered: 

  • Parcel locker/parcel machine delivery (e.g. Omniva, Itella, DPD, Unisend, where available)
  • Courier home/office delivery via the above-mentioned or other logistics partners.

The specific options and final availability are shown at checkout.

5.3. The Customer bears the shipping costs, which are displayed at checkout and depend on the delivery method, destination and order size/weight.

5.4. Estimated delivery times:

  • Estonia: 2–3 business days
  • Latvia, Lithuania, Finland: 3–5 business days
  • Other EU countries: 5–10 business days

5.5. These are indicative delivery times. The Seller is not liable for delays caused by the carrier, customs, holidays, force majeure or other circumstances beyond the Seller’s reasonable control.

5.6. In exceptional cases (e.g. pre-order, supply issue, force majeure), the Seller has the right to deliver Products within up to 45 calendar days. If delivery within this period is not possible, the Seller will inform the Customer and refund the payment if the Customer does not agree to an alternative solution.

5.7. The risk of loss of or damage to the Products passes to the Customer when the Products have been handed over to the carrier chosen by the Customer, or to the Customer directly, depending on the delivery method.

6. RIGHT OF WITHDRAWAL (EU 14 DAYS) AND YELVIO 30-DAY RETURN POLICY

6.1. Statutory 14-Day Right of Withdrawal (EU Consumers)

6.1.1. If the Customer is a consumer residing in the European Union, they have the right to withdraw from the Contract without giving any reason within 14 days from the day they or a third party indicated by them (other than the carrier) have physically received the Product.

6.1.2. To exercise this right, the Customer must submit a clear withdrawal notice (e.g. by email) to the Seller within 14 days. The Seller may provide a withdrawal form template.

6.1.3. The Customer may handle and inspect the Product only as they would be allowed to do in a physical store. If the Product has been used more than necessary to determine its nature, characteristics or functioning, the Seller may reduce the refund amount to reflect the decreased value.

6.1.4. The Customer must return the Product within 14 days from sending the withdrawal notice or provide proof that the Product has been handed over to the carrier within that period.

6.1.5. The Customer bears the direct cost of returning the Product, except where the Product is defective or not as ordered.

6.1.6. The Seller will refund all payments received from the Customer, including standard shipping costs, without undue delay and no later than 14 days from the date on which the Seller receives the returned Product or proof of return.

6.1.7. The 14-day right of withdrawal does not apply to:

  • Legal entities (business Customers);
  • Products that cannot be returned for health or hygiene reasons once unsealed (if applicable and clearly indicated on the Product page);
  • Other exceptions as permitted by EU and Estonian law.

6.2. Yelvio Voluntary 30-Day Return Policy

6.2.1. In addition to the statutory 14-day right of withdrawal for EU consumers, Yelvio offers a 30-day return policy from the date of delivery, provided that:

  • The Product is in the same condition as received.
  • The Product is unused, with all tags attached.
  • The Product is returned in its original packaging with all accessories.
  • Proof of purchase is provided.

6.2.2. If the Customer changes their mind or no longer wants the Product, the Customer is responsible for the cost of return shipping (except during the 14-day statutory withdrawal period, where applicable).

6.2.3. If the Product is defective, damaged or incorrect (wrong Product, wrong variant), the Seller will:

  • Bear the cost of return shipping, and
  • Offer a replacement or full refund in accordance with applicable law.

6.2.4. Sale items are returnable under the same conditions, unless clearly marked as “Final Sale” on the Product page. Final Sale items are non-returnable except in case of defects or non-compliance.

7. RETURN PROCEDURE

7.1. To start a return, the Customer must contact the Seller at support@yelvio.com and provide:

  • Order number
  • Product(s) to be returned
  • Reason for return
  • Photos, if the item is damaged or incorrect.

7.2. If the return is accepted, the Seller will provide: Instructions on how and where to send the Product; A return shipping label, where applicable (e.g. for defective or incorrect Products).

7.3. Products returned without prior notification and approval may not be accepted.

7.4. After receiving and inspecting the returned Product, the Seller will notify the Customer whether the refund has been approved. If approved, the refund will be made to the original payment method within a reasonable time, generally within 10 business days. The bank or card provider may require additional processing time.

8. DEFECTIVE PRODUCTS AND WARRANTY

8.1. The Seller is liable for any lack of conformity of a Product that exists at the time of delivery and becomes apparent within two years from delivery, in accordance with EU and Estonian consumer law. Within the first year from delivery, it is presumed that the defect existed at the time of delivery unless proven otherwise.

8.2. In addition, Yelvio provides a 12-month commercial warranty on most Products, as described on the respective Product pages. If there is any conflict between the commercial warranty and mandatory consumer rights, the terms most favourable to the consumer shall apply.

8.3. If the Customer discovers a defect, they must:
Notify the Seller as soon as reasonably possible, but no later than two months after becoming aware of the defect;

Send a description of the defect and, if possible, photos to support@yelvio.com.

8.4. The Seller is not liable for defects resulting from:

  • Normal wear and tear;
  • Improper use, handling or storage;
  • Failure to follow care instructions;
  • Accidental damage caused by the Customer.

8.5. If the Product is defective and the Seller is responsible, the Seller will:
Repair the Product, or Replace the Product with a new one, or

If repair or replacement is impossible or disproportionate, refund the purchase price and standard shipping costs.

8.6. The Seller will respond to the Customer’s complaint in a durable medium (e.g. email) within 14 days.

9. DIRECT MARKETING AND PERSONAL DATA

9.1. The Seller processes personal data in accordance with applicable laws, including the General Data Protection Regulation (GDPR) and the Personal Data Protection Act of the Republic of Estonia, as described in the Seller’s Privacy Policy.

9.2. The Seller uses personal data primarily for:
Processing orders and delivering Products;

  • Managing customer relationships;
  • Handling returns, complaints and warranty claims;
  • Fulfilling legal obligations (e.g. accounting);
  • Direct marketing (if the Customer has given consent).

9.3. The Seller may send newsletters and marketing offers to the Customer’s email address if the Customer has subscribed or consented. The Customer can unsubscribe from such communications at any time by following the instructions in the email or contacting the Seller.

9.4. The Seller forwards the personal data necessary for delivering Products to the transport service providers and the personal data necessary for executing payments to Maksekeskus AS.

10. LIMITATION OF LIABILITY

10.1. To the extent permitted by applicable law, the Seller is not liable for:
Indirect or consequential damages, such as loss of profit, income or data;

Delays or failures caused by circumstances beyond the Seller’s reasonable control (force majeure), including but not limited to strikes, natural disasters, war, government restrictions, interruptions of transport or communications networks.

10.2. The Seller’s liability is in any case limited to the amount paid by the Customer for the Product(s) giving rise to the claim, unless otherwise provided by mandatory law.

11. DISPUTE RESOLUTION

11.1. If the Customer has any complaints about the Online Store, Products or these Terms, they should first contact the Seller via email: support@yelvio.com.

11.2. If the Customer and the Seller cannot resolve the dispute by agreement, the Customer (who is a consumer) may contact:

  • The Consumer Disputes Committee (Tarbijavaidluste komisjon) via the Consumer Protection and Technical Regulatory Authority;
  • The European Union Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr

11.3. If the Customer is a legal entity, disputes shall be resolved by the courts of the Republic of Estonia, with Harju County Court (or the competent court at the Seller’s registered seat) having jurisdiction, unless otherwise required by mandatory law.

12. GOVERNING LAW

12.1. These Terms and all contracts concluded via the Online Store are governed by the laws of the Republic of Estonia, without prejudice to mandatory consumer protection provisions that may apply under the law of the Customer’s country of residence.

13. AMENDMENTS TO THE TERMS

13.1. The Seller may amend these Terms from time to time. The updated Terms are published in the Online Store with the “Last updated” date.

13.2. For orders placed before the new Terms enter into force, the Terms applicable at the time of placing the order will apply.
